Lawsuits can be made against directors and officers from attorneys general, providers, patients and customers, creditors, regulators, employees, competitors and the company itself.
Our coverage is designed to protect the financial health of the organization as well as personal assets of a health care organization’s directors and officers. D&O Insurance will often pay for legal fees, financial settlements, damages, and some civil penalties if assessed.
In addition, our D&O policy can be designed to provide coverage for allegations of Medicare/ Medicaid health care fraud and abuse, including Recovery Audit Contractor (RAC) and ZPIC audits. For risks that qualify, the definition of “regulatory claim” can include coverage for a search warrant, subpoena, notice of investigation, or contact letter including but not limited to any health care fraud and abuse claim, including a RAC audit notice or letter.
